Terms and Conditions for Elora May Creative Studios
Welcome to Elora May Creative Studios. These terms and conditions outline the rules and regulations for the use of our website and services. By accessing or using our website and services, you agree to comply with and be bound by these terms and conditions. If you do not agree with any part of these terms, please do not use our website or services.
1. Definitions
"We," "Us," "Our" refers to Elora May Creative Studios.
"You," "Your" refers to the user or viewer of our website and services.
"Services" refers to the photography and videography services provided by Elora May Creative Studios.
2. Use of Our Website
You agree to use our website for lawful purposes only and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the website.
You must not use our website to distribute or post spam, malicious software, or any other harmful content.
3. Booking and Payment
All bookings are subject to availability and confirmation by Elora May Creative Studios.
A booking is considered confirmed once the booking fee is paid and the contract is signed.
Payment terms, including the booking fee and final payment, will be outlined in the contract.
All fees are non-refundable.
4. Cancellation and Rescheduling
In the event Client wishes to reschedule the Wedding Date (“Rescheduled Date”), Client will notify Videographer/Photographer as soon as reasonably possible and the Videographer/Photographer will confirm their availability. If Videographer/Photographer is available, the Rescheduled Date will be agreed to in writing by the Parties and any amounts paid under this Agreement will be applied to Services for the Rescheduled Date with all other terms of this Agreement to remain the same. In the event Client wishes to postpone their Wedding Date to a date to be determined, any amounts paid to Videographer/Photographer will be credited to Client and may be used for future Services with Videographer/Photographer for up to one year from the original Wedding Date.
In addition, if less than 30 days’ notice is provided by Client either in the event of rescheduling or postponing the Wedding Date, a non-refundable administrative fee of [$200] will be charged to Client. If the Videographer/Photographer is unable to accommodate any request for rescheduling or postponement any amounts paid to Videographer/Photographer will be forfeited. In all cases, Client will be responsible for any and all expenses incurred by Videographer/Photographer as a result of any rescheduling or postponement of the Wedding Date and Services.

5. Intellectual Property
All content on this website, including but not limited to text, images, videos, and graphics, is the property of Elora May Creative Studios or its content suppliers and is protected by copyright and other intellectual property laws.
You may not reproduce, distribute, or use any content from our website without our express written permission.
6. Client Responsibilities
You agree to provide accurate and complete information when booking our services.
You agree to communicate any specific requests or requirements to us in advance to ensure we can accommodate them.
7. Limitation of Liability
RELEASES AND LIMIT OF LIABILITY
Exclusivity: Client understands and agrees s/he has hired Videographer/Photographer exclusive of any other service provider for the Services listed in this Agreement, and no other Videographer/Photographers, other than any assistant or third party that Videographer/Photographer has hired to complete the Services, are permitted to provide the same Services, paid or unpaid, unless prior permission is granted by Videographer/Photographer. Client accepts and agrees that third-party Videographers or Photographers, whether professional or not, may impede Videographer/Photographer’s access to the clients for crucial photos, and it is Client’s responsibility to ensure the Videographer/Photographer always has the best angle and/or position as determined by the Videographer/Photographer. If the Videographer/Photographer feels its work is being compromised, the Videographer/Photographer has the Client’s permission to approach the Client(s) to ask them to remove the obstructive party or parties.
Guest Photography: If at any time guest photography or filming threatens the ability of the Videographer/Photographer to complete her duties, Client grants Videographer/Photographer permission to ask Guest to kindly stop the disrupting behaviour. Should the guest refuse to cooperate, Videographer/Photographer will not be held responsible for any lack of fulfilment of the Services. It is strongly encouraged to deter guests from filming or taking photos during the ceremony or private photo session.
Artistic Release: Client has spent a satisfactory amount of time reviewing Videographer/Photographer’s work or past client reviews and has a reasonable expectation that Videographer/Photographer’s Services will produce a similar manner and style of aesthetic for Client. Videographer/Photographer will use reasonable efforts to ensure Client’s Services are carried out in a style and manner consistent with Videographer/Photographer’s current portfolio and Videographer/Photographer will try to incorporate any suggestions Client makes. However, Client understands and agrees that:
Every client and photoshoot is different, with different tastes, budgets, and performance needs;
Styling is a subjective art and Videographer/Photographer is an artist with a unique vision, with an ever-evolving style and technique;
Videographer/Photographer will use his/her personal artistic judgment which may not include strict adherence to Client’s suggestions; and
Dissatisfaction with Videographer/Photographer’s aesthetic judgment or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.
8. Privacy Policy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information.
9. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the province of British Columbia, Canada.
Any disputes arising out of or related to these terms and conditions will be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.
10. Changes to These Terms and Conditions
We may update these terms and conditions from time to time. We will notify you of any significant changes by posting the new terms and conditions on our website with the updated date.
Your continued use of our website and services after any changes constitutes your acceptance of the new terms and conditions.
